Cardsticker Terms & Conditions
1. Who are we?
(1) Youno is located at Oostzaan 433, 9716 KS Groningen, The Netherlands (CoC number: 69151113, VAT number: NL223201650B02) and will hereafter also be referred to as “Cardsticker” or “we”.
(2) Cardsticker sells and delivers stickers via the web shop cardsticker.org (hereafter also referred to as: products).
2. Applicability
(1) These terms and conditions apply to every offer made by Cardsticker and to every order you place with us. The customer will hereafter also be referred to as “customer” or “you”.
(2) We may change these terms and conditions from time to time. The version that applies to an order is always the version in force at the moment you place that order.
3. The offer
(1) Our offer contains a description of the products that is as complete and accurate as possible. Obvious mistakes or errors in the offer, for example in the price, do not bind Cardsticker.
(2) Colours may be displayed differently from one screen to another; the delivered product may therefore differ slightly in colour from the image in the web shop.
(3) Our offer is aimed at consumers. The products are not intended for resale.
4. Conclusion of the agreement
(1) You place an order through the ordering process in our web shop. An account is not required: you can also order as a guest.
(2) The agreement is concluded at the moment you complete and pay for the order and we confirm the order to you by email.
(3) Cardsticker reserves the right to refuse or cancel an order, for example when fraud or abuse is suspected. You will be notified, and any amount already paid will be refunded in full.
5. Your obligations
(1) The details you provide during the ordering process, such as your name, address and email address, must be correct and up to date. Cardsticker is not liable for delays or incorrect delivery caused by incorrect or incomplete details.
(2) If you create an account, you must keep your password secret. Orders placed with your account are for your account, unless you have informed us in time that your password has become known to third parties.
6. Delivery
(1) We ship our products by post from the Netherlands and deliver throughout Europe.
(2) The delivery time depends on the destination country and is usually a few working days after payment. This is an indication, not a strict deadline. We will deliver no later than thirty (30) days after your order, unless a different term has been agreed. If we fail to do so, you may cancel the order free of charge and we will refund the full amount paid.
(3) We deliver to the address you provided as the delivery address during the ordering process.
(4) Any shipping costs are shown during checkout before you place the order.
(5) The risk of damage to or loss of the products passes to you as soon as the products have been delivered to the delivery address provided.
7. Prices
(1) Prices include VAT and exclude any shipping costs, unless stated otherwise.
(2) We may adjust our prices. A price change does not apply to orders that have already been placed; you pay the price that applied at the moment of ordering.
8. Payment
(1) You pay at the moment of ordering, using one of the payment methods shown during checkout, such as credit card (Visa, Mastercard), Apple Pay and Pay by Bank. Payment is processed by our payment service provider Mollie B.V.
(2) All orders are one-off purchases. There is no subscription, recurring payment or direct debit; we never withdraw money from your account ourselves.
(3) Without a successful payment, no agreement is concluded and the order will not be processed or shipped.
9. Discount codes
(1) Cardsticker may offer discount codes. A discount code can only be redeemed in our web shop, is valid once only and cannot be exchanged for money.
(2) Discount codes cannot be combined with other discount codes or offers, unless stated otherwise. Some discount codes are only valid for certain products or during a certain period.
(3) In the event of (attempted) fraud or abuse, Cardsticker may withdraw or invalidate a discount code.
10. Liability of Cardsticker
(1) Cardsticker is only liable for material damage and/or personal injury suffered by the customer if that damage is the direct and exclusive result of a failure by Cardsticker to fulfil an obligation, or in the event of intent or deliberate recklessness on the part of Cardsticker or its employees, on the understanding that only damage against which Cardsticker is insured, or reasonably should have been insured, qualifies for compensation.
(2) Liability of Cardsticker for indirect damage, including consequential damage, loss of profit or income, missed savings et cetera, is excluded.
(3) Cardsticker is not liable for damage resulting from incorrect or incomplete details provided by you, and you indemnify Cardsticker against any third-party claims related thereto.
(4) Cardsticker is never liable for damage resulting from force majeure, including but not limited to: strikes, illness, fire, malfunctions at Cardsticker or its suppliers, transport problems and extreme weather conditions. Force majeure also includes such unforeseen circumstances at third parties that Cardsticker uses in the performance of the agreement.
(5) The liability provisions in the preceding paragraphs also apply to the (personal) liability of bodies, employees and auxiliary persons of Cardsticker. They may invoke these provisions.
11. Privacy
(1) When handling an order we process your personal data. How we handle your data is described in our privacy policy at https://www.cardsticker.org/privacy-policy/. Questions about the handling of your personal data can be sent to info@cardsticker.org.
12. Fraud
(1) We reserve the right to investigate orders where we suspect incorrect or fraudulent activity, and to refuse or cancel such orders.
13. Complaints
(1) Quality is paramount at Cardsticker and we do everything we can to prevent complaints. Should you nevertheless have a complaint, you can contact info@cardsticker.org. We will provide a substantive response to your complaint within five (5) working days.
14. Intellectual property
(1) Our website and services are protected by intellectual property rights. The rights to, for example, logos, software, texts, designs and images belong to Cardsticker and/or its licensors. It is not permitted to publish, reproduce and/or edit parts of our website, designs or services without our express permission, other than for personal use.
(2) If you design or personalise a sticker yourself with your own image, text or logo, you warrant that you have the right to use that material and that it does not infringe the rights of third parties and is not unlawful. You indemnify Cardsticker against third-party claims in this respect. Cardsticker may refuse an order if, in its opinion, the supplied material is infringing or unlawful.
15. Withdrawal and returns
(1) For stickers with a ready-made design from our collection you have the right to withdraw from the agreement within fourteen (14) days of receiving your order, without giving any reason. You notify us by email at info@cardsticker.org, stating your order number. The costs of returning the product, such as postage, are at your own expense. After receipt and inspection of the return, we will refund the purchase amount within fourteen (14) days using the same payment method.
(2) The right of withdrawal does not apply to stickers that you have designed or personalised yourself (with your own photo, text or image). These are made to your specifications and are, under Article 6:230p(f) of the Dutch Civil Code, exempt from the right of withdrawal. If a product is damaged, faulty or incorrect, you are always entitled to free repair, replacement or a refund.
(3) To withdraw from the agreement you may use the model withdrawal form in Annex I at the bottom of this page, but you are not obliged to do so; a clear email stating your order number is sufficient. See also our return policy at https://www.cardsticker.org/return-policy/.
16. Other provisions
(1) All agreements between Cardsticker and the customer to which these terms and conditions apply are governed exclusively by Dutch law. If you are a consumer, this choice of law cannot deprive you of the protection of the mandatory provisions of the law of the country where you have your habitual residence (Article 6 of Regulation (EC) No 593/2008, “Rome I”).
(2) All disputes arising from the agreement between Cardsticker and you as a customer will be adjudicated exclusively by the court of Groningen, the Netherlands. If you are a consumer, you also retain the right to bring the matter before the competent court of your own place of residence, in accordance with the applicable mandatory rules.
(3) Should any provision in these terms and conditions or in the agreement be or become legally invalid, the remaining provisions will remain in force. In that case, the invalid provision will be replaced by a new provision that corresponds to the old one as closely as possible in content, scope and/or purpose.
