Cardsticker Terms & Conditions

1. Who are we?

\n\n\n\n

(1) Youno is located at Oostzaan 433, 9716 KS Groningen, The Netherlands (CoC number: 69151113, VAT number: NL223201650B01) and will hereafter also be referred to as “Cardsticker” or “we”.

\n\n\n\n

(2) Cardsticker sells and delivers stickers (hereafter also referred to as: products).

\n\n\n\n

2. Applicability

\n\n\n\n

(1) These terms and conditions apply to all agreements that Cardsticker enters into with customers. The customer is hereafter also referred to as: “customer” or “you”.

\n\n\n\n

(2) We reserve the right to amend these terms and conditions. We will notify you of any intended changes at least seven (7) days in advance. If you object to the amended terms, you have the option to terminate your agreement, in which case you can cancel via your account or one of our contact channels on our website (https://www.cardsticker.org/contact/), taking into account the cancellation and withdrawal deadline available via the FAQ or your account. If you do not terminate the agreement (in time), and you continue to use our products from the announced effective date of the amended terms, then those amended terms will apply to your agreement from that moment on.

3. The offer

\n\n\n\n

(1) The products and/or services offered, including the listed prices, constitute a non-binding offer that may be accepted by you.

\n\n\n\n

(2) Our offer contains a description of the products and/or services offered that is as complete and accurate as possible. However, we cannot prevent mistakes from occasionally occurring, and we note that obvious mistakes in the offer do not bind Cardsticker.

\n\n\n\n

(3) Our offer is aimed at end users. The ordered products are expressly not intended for resale. Therefore, only household-sized orders are accepted.

\n\n\n\n

4. Conclusion of the agreement

\n\n\n\n

(1) To place an order we ask you to create an account to manage your order and preferences, allowing you to place orders more quickly and easily in the future. In your account you can specify the size of your order.

\n\n\n\n

(2) After creating an account, you can fully complete and confirm the (online) order form provided by Cardsticker in the ordering process. By completing the (online) order form, you submit a quotation request to Cardsticker. Receipt of the submitted request is confirmed electronically immediately. However, this order confirmation does not automatically constitute acceptance of the quotation, and no agreement is immediately concluded.

(3) Cardsticker reserves the right to refuse the quotation without giving reasons.

\n\n\n\n

(4) An agreement may be entered into for an indefinite or definite period.

\n\n\n\n

(5) To create a Cardsticker account and place an order, you must be eighteen (18) years of age or older. Cardsticker does not sell or deliver products to persons under the age of eighteen (18).

\n\n\n\n

(6) Cardsticker likes to occasionally surprise you with extra products, such as a sample or third-party offers. However, you cannot derive any rights from receiving extra products, for example by promotion through our channels and/or social media.

\n\n\n\n

5. Your obligations

\n\n\n\n

(1) All information you provide to Cardsticker at any time, for example during the ordering process, must be current and truthful. Your password may not be shared with third parties. You must keep the password safe and protected from unauthorized persons and notify us in writing of any loss or disclosure. You bear full responsibility for any misuse, for example any unauthorized order with your password by third parties and any resulting claims. Cardsticker is not liable for any damage resulting from incorrect information and/or loss of your password, and you indemnify Cardsticker against any claims from third parties.

(2) You are obliged to carefully read and observe the product labels, product and usage instructions, and warnings that accompany the delivered products. Cardsticker is not liable for any damage resulting from failure to follow product labels, product and usage instructions, and warnings, and you indemnify Cardsticker against any claims from third parties.

\n\n\n\n

6. Delivery and Returns

\n\n\n\n

(1) The delivery time windows, as stated in the customer account on the website, in the app, and in the confirmation email, are indicative. The delivery day and/or time window you choose may vary due to unforeseen circumstances, force majeure, or holidays.

\n\n\n\n

(2) In certain cases, Cardsticker may charge additional fees for delivery within a specific time window. Any additional fees charged for the delivery of your ordered products will always be communicated in advance when selecting the time window.

\n\n\n\n

(3) We reserve the right to deliver only after payment of 50% of the total order amount. Where advance payment has been stipulated, you cannot assert any rights regarding execution of the relevant order before the stipulated advance payment has been made.

\n\n\n\n

(4) We deliver worldwide. If the agreement concerns a gift card, voucher, or discount code, it will be sent by email.

\n\n\n\n

(5) We deliver to the address you have specified as the delivery address in your customer account on our website. An address change takes effect for delivery if communicated to us before the deadline for changes.

\n\n\n\n

(6) You are required to ensure that personal delivery of the products is possible at the delivery address you have specified and during the time window you have specified. If delivery is not possible, you are in default regarding acceptance; any costs and damages will be at your expense.

\n\n\n\n

(7) If personal delivery of the products is not possible, the agreement may be fulfilled by offering the products to neighbors or placing them in front of the door. You can indicate this as a delivery note in your customer account. Delivery in this manner is entirely at your own risk, and Cardsticker is not responsible for any spoilage or loss of the products. The delivery note is not binding, and Cardsticker may deviate from it, for example in cases of (extreme) weather conditions where product quality can no longer be guaranteed, or other cases of force majeure (§11(5)).

\n\n\n\n

(8) The Customer is not entitled to the right of withdrawal as referred to in Article 6:230o of the Dutch Civil Code, because this concerns the delivery of Products with a limited shelf life. Under Article 6:230p of the Dutch Civil Code, this right is excluded. Cardsticker also does not accept Product returns on other grounds than those referred to in the previous paragraph. Products cannot be returned by the Customer, even if the Products are still in good condition.

7. Prices and shipping costs

\n\n\n\n

(1) Prices include VAT and exclude shipping costs, unless stated otherwise.

\n\n\n\n

(2) Cardsticker’s claims are immediately due and payable.

\n\n\n\n

(3) For payment, you can only use the payment methods agreed upon and indicated at the time of ordering. You are obliged to pay within the agreed payment term.

\n\n\n\n

(4) Cardsticker is entitled at all times to adjust prices, provided that we notify you at least fourteen (14) days in advance. If you object to the amended price, you have the option to terminate the agreement, for example by contacting us via the website https://www.cardsticker.org/contact). If you do not terminate the agreement, and you continue to use our products and/or services from the announced effective date of the amended price, then the amended prices will apply to the agreement from that moment on.

\n\n\n\n

(5) If after cancellation you wish to subscribe again, you will pay the (new) prices that apply at that time.

\n\n\n\n

8. Payment

\n\n\n\n

(1) Orders are charged via the payment method you have specified.

\n\n\n\n

(2) It is your own responsibility to ensure that the details of your payment method are valid and up-to-date. We accept iDeal, PayPal, Apple Pay, and Credit card for single orders, and SEPA / direct debit / Credit card for subscription payments.

\n\n\n\n

(3) Only the first delivery can be paid via iDeal. If you choose iDeal payment in the ordering process, the amount of the first order will be debited from your account immediately. Additionally, you authorize Mollie BV (acting for Cardsticker) to send recurring SEPA direct debit orders to your bank to debit an amount from your account.

\n\n\n\n

(4) If in the ordering process you choose payment via PayPal or credit card, the amount will be continuously debited from your PayPal account or credit card.

\n\n\n\n

(5) It is your own responsibility to ensure that you have sufficient funds in your bank account at the time of payment.

\n\n\n\n

(6) If you disagree with a SEPA direct debit as referred to in §8(3), or a payment via PayPal or credit card as referred to in §8(4), you can reverse it under the conditions agreed between you and your bank. Contact your bank within eight (8) weeks of the debit. Ask the bank about the conditions.

\n\n\n\n

(7) If a payment order cannot be executed due to insufficient funds, incorrect or outdated payment details, and/or other disputes, orders may still be dispatched. In such cases, Cardsticker will re-attempt the payment. We reserve the right to reclaim the outstanding amount by re-executing the payment via the specified payment method.

\n\n\n\n

(8) Should re-attempts to execute the payment fail, we reserve the right to recover the debt by other means, either directly or through a third party, and to recover the associated extrajudicial collection costs from you.

\n\n\n\n

(9) Cardsticker is entitled to suspend execution of the agreement, such as delivering orders, if and as long as you as the customer have not (fully) met your payment obligations.

\n\n\n\n

9. Vouchers, discount codes, gift cards

\n\n\n\n

(1) Cardsticker offers gift cards, discount codes, and other voucher variants, where activation by email is necessary so that customers can receive Cardsticker products. Once a voucher has been redeemed via the website, it can no longer be used and is invalid.

\n\n\n\n

(2) Discount codes and vouchers can only be redeemed on the Cardsticker website and can only be used once. Discount codes and vouchers cannot be combined with other offers and are not redeemable for cash. Note that some discount codes are only valid on certain types of products.

\n\n\n\n

(3) Any (attempted) fraud or other unauthorized activity is recorded and results in denial of the free trial period and/or discount codes. Cardsticker has the right to withdraw or invalidate discount codes and vouchers if it deems this necessary for any reason.

\n\n\n\n

10. Cardsticker liability

\n\n\n\n

(1) Cardsticker is only liable for property and/or personal injury damage suffered by the customer if such damage arose as a direct and exclusive result of Cardsticker’s failure to meet an obligation, or if there is intent or willful recklessness by Cardsticker or its employees, provided that only such damage is eligible for compensation for which Cardsticker is insured, or reasonably and fairly should have been insured.

\n\n\n\n

(2) Cardsticker’s liability for indirect damage, including consequential damage, lost profits or income, missed savings, etc., is excluded.

\n\n\n\n

(3) Cardsticker is never liable for any damage as a result of incorrect information provided by you and/or loss of your password, and you indemnify Cardsticker against any claims from third parties.

\n\n\n\n

(4) Cardsticker is never liable for any damage due to failure to follow product and usage instructions and warnings given by Cardsticker, and you indemnify Cardsticker against any claims from third parties.

\n\n\n\n

(5) Cardsticker is never liable for damage resulting from force majeure, which includes, but is not limited to: strikes, illness, fire, disruptions at Cardsticker or its suppliers, transport problems, weather conditions, violence, riots, or actions by police and/or fire services. Force majeure also includes such unforeseen circumstances at third parties used by Cardsticker in performing the agreement.

\n\n\n\n

(6) The liability provisions in the preceding paragraphs also apply to (personal) liability of bodies, employees, and auxiliary personnel of Cardsticker. They may rely on these provisions.

\n\n\n\n

11. Privacy

\n\n\n\n

(1) We process your personal data when handling an order. To inform you about what happens to your personal data, we maintain a privacy statement that you can find on our website or via https://www.cardsticker.org/privacy-policy. Questions about how Cardsticker handles your personal data can be directed to info@cardsticker.org

\n\n\n\n

(2) If you place an order, Cardsticker uses your email address to offer you similar products and services by email. If you no longer wish to receive newsletters, you can unsubscribe or change your preferences at any time. This can be done via the link at the bottom of emails or via our customer service. You can also unsubscribe via the settings in your customer account. More information about email marketing and the use of your personal data in our other marketing channels can be found at https://www.cardsticker.org/privacy-policy/.

\n\n\n\n

12. Fraud

\n\n\n\n

(1) We reserve the right to investigate any accounts we suspect of incorrect or fraudulent activity.

\n\n\n\n

(2) We reserve the right to block or terminate your order, membership, and/or account following incorrect or fraudulent activity.

\n\n\n\n

13. Complaints

\n\n\n\n

(1) Quality is very important at Cardsticker, and we do everything we can to prevent complaints. Should you have a complaint, you can contact info@cardsticker.org. We will respond substantively to the complaint within five (5) business days.

\n\n\n\n

14. Intellectual property

\n\n\n\n

(1) Our app, website, and services are protected by intellectual property rights. The rights to, for example, logos, software, texts, and images belong to Cardsticker, its group companies, and/or the licensor. It is not permitted to publish, reproduce, and/or modify parts of our app, website, or services without our express permission, other than for personal use.

\n\n\n\n

15. Withdrawal

\n\n\n\n

(1) You have the right to withdraw from the agreement within a period of fourteen (14) days from the delivery of your first order, without giving any reason. You will then only pay for orders already delivered during these fourteen (14) days and for orders already scheduled. To prevent the order (and therefore also delivery and payment obligation) for the next order, you must simultaneously cancel your subscription by email info@cardsticker.org.

\n\n\n\n

(2) You also have the right to withdraw the order for certain additional products within a period of fourteen (14) days from delivery, without giving any reason. Additional products with a limited shelf life (including perishable products) cannot be withdrawn. The cost of returning the product is at your own expense.

\n\n\n\n

(3) To withdraw from the agreement, you can use the model form found in Appendix I of the Terms & Conditions, or download the model form in PDF. You may use the model form but you are not obliged to do so (for alternatives, see: https://www.cardsticker.org/contact/).

\n\n\n\n

16. Other provisions

\n\n\n\n

(1) Dutch law applies exclusively to all agreements between Cardsticker and the customer to which these terms and conditions relate.

\n\n\n\n

(2) All disputes arising from the agreement between Cardsticker and you as customer will be adjudicated exclusively by the court in Groningen.

\n\n\n\n

(3) If a provision in these terms and conditions or in the agreement is or becomes invalid, the remaining provisions will remain valid. In that case, the invalid provision will be replaced by a new provision that corresponds as much as possible to the old one in content, scope, and/or objective.
